Protecting your privacy is as important to iBalans LLC and its affiliate companies (the “Company”, “we” or “us”) as it is to you. This Privacy Policy is intended to inform you of our policies and practices regarding the collection, use and disclosure of the information that you submit to us through the www.wavtrainer.com website (the “SITE”). Please read this Privacy Policy carefully.  Accessing our SITE is voluntary, and by accessing or using our SITE, you acknowledge that: you have read and understood this Privacy Policy; agree that your access and use of the SITE is subject to the Privacy Policy; and consent to our collection and use of your Personal Information as described in this Privacy Policy, as updated or revised from time to time. At all times, we reserve the right to disclose any information, including Personal Information, to comply with any applicable law, regulation, legal process or governmental request; to protect our rights or property (including without limitation in the event of a transfer of control of the company, or substantially all of its assets), or during emergencies when safety is at risk.

Please note that Personal Information gathered through the SITE may be processed, stored and accessed by the Company on its servers and in databases located in the country where it was collected, as well as in other countries.

Children and Parents

Use of the SITE is not offered to children. If you are under 13, you may not use the SITE and we request that you not submit any Personal Information to the Site. Parents and guardians are advised that any Personal Information voluntarily entered by children may be available for public access. If your child has submitted Personal Information, please contact us to request that such Personal Information be removed from our databases and storage areas. Once we are aware of Personal Information entered by a child, we will exercise reasonable efforts to remove such Personal Information from our databases and storage areas; however, we are not liable, directly or indirectly, for any claims, demands, damages, injuries, losses, liabilities, costs, or other consequences relating to any such Personal Information. Please note that we do not knowingly collect Personal Information from children under the age of 13. Since information regarding children under the age of 13 is not collected, we do not knowingly distribute Personal Information regarding children under the age of 13.

How and Why We Collect Personal Information

The various personal information we gather from and about you from the SITE, including the information you provide to us and the information about you that we collect from our use of cookies and other technologies (collectively, “Personal Information”) helps us learn about visitors to the SITE and those that may be interested in the topics we address on the SITE, including existing and prospective iBalans product customers.  We use this information to better tailor the SITE, to refine the features, performance and service relating to our products, and to offer you additional information and opportunities. 

You submit Personal Information to us voluntarily through our SITE in the following ways:

  • When you register on the SITE to set up an account (necessary to purchase products, for instance)
  • When you indicate you are interested in receiving information about our products or promotional offers
  • When you indicate you are interested in receiving further wellness or fitness-related information
  • When you indicate you are interested in receiving our e-newsletter
  • When you contact us by sending us an email
  • When you participate in a sweepstakes, contest, game or survey offered on the SITE

Such Personal Information may include, without limitation, your contact information such as your name, email address, billing/shipping address (including city and state), and telephone number. Although we deploy customary security protocols and technology, you should understand that you are providing any Personal Information you may provide to us through the SITE at your own risk.

This type of information is collected to make our services and solutions more useful to you. 

Finally, we may receive Personal Information about you from other sources like postal mail, telephone or fax. We may add this information to the information we have already collected from you via our SITE, in order to improve the products and services we provide and to update our records.

Cookies

Security and Security Breaches

To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of the Personal Information we have collected, we have put in place physical, electronic, and managerial procedures designed to safeguard and secure your Personal Information. Still, security breaches are possible, and we cannot guarantee that a breach will not occur. In the event that you are significantly concerned about a security breach involving your Personal Information, do not provide your Personal Information on the SITE, and/or do not access the SITE. 

In the event that we believe that the security of your Personal Information in our possession or control may have been compromised, we may seek to notify you. If a notification is, in our sole discretion, appropriate, we would endeavor to do so as promptly as possible under the circumstances, and, to the extent we have your email address, we may notify you by email. How We Use the Personal Information We Collect

The Company uses the Personal Information you provide to provide the services you have requested.  For instance, we will use your Personal Information to provide you with certain additional product or movement training information as offered on the SITE upon your indication to us (through “Opt In”) that you are interested in receiving such. In addition, we will use your Personal Information as necessary to provide you with our newsletter and with promotional offers upon “Opt In” as further described in the “Opt Ins” and Email Communications” section below. 

In order to make improvements in the way we communicate and interact with customers, we may also aggregate data based on Personal Information in order to prepare internal reports. For example, we may collect and analyze collected aggregate information to determine how many visitors arrived at certain pages of the SITE, how long they stayed on those pages, and where they went afterwards. This information is de-identified.

In some instances, we use third party companies to assist us in managing Personal Information, to fulfill promotions and to communicate with you. Some of these companies are given access to some or all of your Personal Information and some may use cookies on our behalf. We may do so when: (1) permitted or required by law; or, (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or, (3) investigating fraud which has already taken place. The Personal Information is not provided to these agencies or companies for marketing purposes.

Your Personal Information may be combined with other personally identifiable information (such as demographic information and past purchase history) available from our records and other sources. This combined information may be used to make our future marketing efforts more efficient. This aggregated, de-identified information may also be shared with other marketers to bring you offers of interest, assuming you have “Opted In” to receive promotional offers. If you provide feedback on any of our products and services to us, we may use your feedback for any purpose. We will collect any information contained in your communication and will treat the Personal Information provided in connection with your communication in accordance with this Privacy Policy.

We may from time to time operate sweepstakes, contests, raffles, games and similar promotions through the SITE. We typically ask you for certain Personal Information when you enter and, if applicable, win a sweepstakes, contest, raffle, game or similar promotion. We reserve the right to share this particular Personal Information with any third party sponsors or agencies involved with such sweepstakes, contests, raffles, games and promotions, or otherwise in accordance with the Rules applicable to such sweepstakes, contest, raffle, game or promotion. You should carefully review the Rules of each sweepstakes, contest, raffle, game and promotion in which you participate through the SITE, as they may contain additional important information about our or a sponsor's use of the Personal Information you provide in connection with that program.

In the event there is a change in our corporate structure, such as, but not limited to, merger, consolidation, sale, liquidation, or transfer of substantial assets, we may, at our sole discretion, transfer, sell or assign any data or information collected on and through this SITE, including without limitation, your Personal Information, to one or more affiliated or unaffiliated third parties.

“Opt Ins” and Email Communications

The Company sends out email or postal updates from time to time regarding our products, special events, and promotions.  We will only use your Personal Information to send promotional emails or mailings to you if you have “Opted In” to receive such materials from us on the SITE, on the home page, at the time of registration on the registration page, or on your account profile page.  On the home page of the SITE, we also invite you to receive our e-newsletter, and if you “Opt In” to receive the e-newsletter, we will use your Personal Information to add your name and email address to our standard distribution list to receive the e-newsletter until you advise us you no longer wish to receive it. 

When you receive e-newsletters or promotional communications from us, you may indicate a preference to stop receiving further such communications from us at any time.  You will have the opportunity to "opt-out" of further participation by following the "unsubscribe" instructions provided in the email you receive, or by contacting us directly by email at any time at legal@ibalanslife.com.  Please note, however, that if you "opt out" as described above, we will not entirely remove all Personal Information relating to you from our and/or our affiliate’s databases, although such Personal Information will thereafter no longer be used in personally identifiable form. In addition, the various vendors, suppliers and service providers with which we have already shared your Personal Information in connection with your prior “Opt Ins” may continue to have such Personal Information in their records.

We also use email as a general means of communicating with our customers. We love to hear from you, and we encourage you to email us with your questions or comments. We read every email we receive.

Our SITE may provide a link to another website or location. We provide these links merely for your convenience and we do not necessarily endorse such other website or location or its contents. We have no control over, do not review, and are not responsible for these other websites or their content. Our Privacy Policy does not apply to these other websites. Privacy Policy Updates
